2023 saw a major uptick in the volume of class action lawsuits filed against universities and higher education systems as a result of data breaches and alleged privacy violations. These lawsuits target the collection, use and safeguarding of data shared with a university–whether through online websites, student portals, or in-person means. While harm from data breach is well established, courts are mixed when it comes to harm from online disclosures by universities. This presentation will survey cyber and privacy class-action litigation against educational institutions and provide actionable strategies for universities to implement to mitigate the risk of being named a defendant in privacy/cyber class-action lawsuit.
